Welcome to the Tobaccoland App and Website (the “App and Website”), a product of Critical Telephone Applications, Inc. d/b/a Tobaccoland (“Tobaccoland”, “we”, or “us”). This platform is provided on behalf of our service partner retail liquor store (“Retailer”) to enable you to:

  • Search your Retailer’s product inventory.
  • Order products and services from your Retailer.
  • Gain access to product and service promotions.
  • Track your frequent shopper/loyalty credits.
  • All of this is accessible from the convenience of your iOS or Android mobile device.

Terms of Service

THE FOLLOWING TERMS OF SERVICE (THE “AGREEMENT”) GOVERN YOUR ACCESS TO AND USE OF THE APP AND WEBSITE, AS WELL AS YOUR RELATIONSHIP WITH TOBACCOLAND. BY ACCESSING OR USING THE APP AND WEBSITE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  • You are at least twenty-one (21) years of age.
  • You have read and understood this Agreement and the Privacy Policy.
  • You have the authority and capacity to enter into this Agreement.
  • Your use of the App and Website is for your sole and personal use.
  • You have not been previously suspended or removed from the App and Website.
  • You agree to be bound by this Agreement and the Privacy Policy.

This Agreement is a legally binding electronic contract between you and Tobaccoland. If you do not agree with any of the terms and conditions herein, close the App and Website immediately and do not use them further.

Eligibility

The App and Website are not intended for use by children. You must be at least twenty-one (21) years old to access or use the App and Website. By accessing the App and Website, you agree to comply with all applicable laws in your jurisdiction. Additionally, you represent and warrant that you are not a competitor of Tobaccoland, are not accessing or using the App and Website on behalf of a competitor, and will not use the App and Website in a competitive context with Tobaccoland.

Definitions

  • “App and Website”: The mobile application or website owned and operated by Tobaccoland.
  • “Tobaccoland IP”: Intellectual property owned, controlled, or licensed by Tobaccoland, including the Site, System, and all Content shared through them.
  • “Console”: The web-based software interface used by Retailers to access the System and share content with Tobaccoland, Users, and third parties.
  • “Content”: Any intellectual property, data, or communications shared via the System.
  • “Derivative Work”: Any work based on Tobaccoland IP, including enhancements, modifications, translations, compilations, or adaptations.
  • “Promotions”: Special events offered through the Tobaccoland platform to provide information about products, services, and availability.
  • “Retailer”: A retail liquor store with a contractual relationship with Tobaccoland to use the System and share content.
  • “Share”: To transmit content via the System, including through the App, Website, or Console.
  • “Site”: The online presence of Tobaccoland at https://www.tobaccoland.com/.
  • “System”: The proprietary Tobaccoland software system that allows Retailers to share content and provide services to Users.
  • “User”: Any individual accessing or using the App and Website.
  • “User Content”: Content shared by a User, such as product reviews, pictures, ratings, and feedback.
  • “User Information”: Personally identifiable information collected by the App and Website, such as email address, password, and preferences.
  • “Your Profile”: The collection of User Information stored by the App and Website.
  • “Your Content”: Content you share, including product reviews, ratings, and feedback.
  • Your Account
  • To use the App and Website, you must:
  • Download the App and Website to your mobile device.
  • Create a personal account (“Your Account”) by sharing certain User Information and selecting a password.
  • You are solely responsible for maintaining the confidentiality and security of Your Account and password. You may not authorize others to use Your Account or transfer it to another person. If you suspect any unauthorized use of Your Account, notify Tobaccoland immediately.

Privacy Policy

Tobaccoland respects your privacy and is committed to protecting your personally identifiable information. All use of such information is governed by our Privacy Policy, which is detailed in the Privacy Policy section of this document.

Security of Information

Tobaccoland employs commercially reasonable industry standards to preserve the integrity and security of your User Information and Content. However, no system is completely secure, and Tobaccoland cannot guarantee the absolute security of your information. Use the App and Website at your own risk.

Tobaccoland Intellectual Property

All Tobaccoland IP is owned, controlled, or licensed by Tobaccoland and is protected by copyright, trademark, patent, and other intellectual property rights. Unless otherwise noted, you may not copy, reproduce, modify, or exploit Tobaccoland IP without prior written consent.

License to User

Tobaccoland grants you a limited, non-exclusive, non-transferable license to use the App and Website for the following purposes:

Sharing your Content and User Information with Tobaccoland and your Retailer.

Accessing the System to purchase products and services from your Retailer.

Viewing Content shared via the System by Tobaccoland, your Retailer, and other Users.

This license terminates automatically if you breach this Agreement.

Prohibitions

You may not:

  • Modify, reproduce, or reverse-engineer any Tobaccoland IP without prior consent.
  • Take actions that impose an unreasonable load on the System’s infrastructure.
  • Use automated tools like bots or scrapers to access the System.
  • Transfer Your Account or any portion of Tobaccoland IP to third parties.
  • Use Tobaccoland IP for illegal purposes or in violation of this Agreement.
  • Sell unauthorized products, including drugs, tobacco-related items, or controlled substances.

Data Protection

Tobaccoland maintains administrative, physical, and technological measures to protect your Personal Information. However, no system is completely secure, and you acknowledge the risks associated with sharing information online. Use the App and Website at your own risk.

Reservation of Rights

Tobaccoland reserves all rights not expressly granted in this Agreement. Unauthorized use of Tobaccoland IP may result in legal action.
